Concern residents of Bwari Area Council by the names Hassan Gimba Zakari and Ibrahim Abdul are seeking for the disqualifications of Hon. John Gabaya Shekwogaza, the incumbent Chairman of of Bwari Area Council and the Candidate of the People’s Democratic Party(PDP) in the forthcoming Councils election in the Federal Capital Territory and Audi Haruna Shekwolo, the candidate of the All Progressive Congress APC) in the next Councils Election in FCT.
In the separate Suit No: FHC/ABJ/CS/504/2021 and Suit No: FHC/ABJ/CS/503/2021 issued by the Federal High Court Abuja, Nigeria, the two individuals who were Chairmanship aspirants of their various political parties in the last primary elections are praying the Honorable court to stop the candidates from participating in the forthcoming polls on the ground that they were not validly nominated by their parties.
In the originated Summons filed by M. A. Ebute (SAN), Hassan Gimba Zakari claimed that the 1st defendant John Gabaya Shekwogaza and His running mate blatantly submitted to the 4th defendant forged certificates and documents and therefore not qualified to participate in the primary election in the first place as their actions contravened section 106, 107, and 31(15) of the electoral act as amended.
The plaintiff, Hassan Gimba Zakari who refer to himself as concern Bwari resident in the affidavit in support of his claims pray the honourable court to declare that the presentation of Hon. John Gabaya Shekwogaza and His running mate as flag bearers of His Party (PDP) was illegal, null and void, because they both failed to meet the conditions provided in the electoral act as amended.
In the suit no. FHC/ABJ/CS/503/2021, Ibrahim Abdul, a member of the All Progressives Congress (APC) and an aspirant in the primary election, He accused the 1st defendant (Audi Haruna Shekwolo) of committing electoral fraud, manipulations of results that is capable of depriving the good people of Bwari Area Council good governance.
In the affidavit to back up his claims, Ibrahim Abdul alleged that the 1st defendant for the purpose of contesting the 2022 FCT councils poll election submitted to the 3rd defendant forged documents and hence fraudulently admitted as the party (APC) candidate.
The plaintiff also alleged that the 1st defendant who was a civil servant with Bwari Area Council failed to comply with the provisions of the electoral act as amended. Inline with the law, the 1st defendant ought to have resigned from the service of Area Council Service Commission at least 30 days before the date of the primaries.
According to the Documents made available to THE SUMMIT, the 1st defendant letter of withdrawal from service was approved on the 13th of April, 2021 while the primaries of the All Progressives Congress was held on 30th April, 2021.
The petitioner equally alleged that the 1st defendant on account of false declarations and Statements made to the 3rd defendant which includes his refusal to complete the form EC9 as stipulated in the electoral act as amended is not qualified to contest the forthcoming Bwari Area Council Chairmanship elections.
The two cases were filed on the 23rd of July, 2021 and has been adjourned to 30th August, 2021 for hearing.
