The Supreme Court has ruled in favor of the Trump administration, allowing it to proceed with the termination of 16,000 probationary federal workers across six agencies and departments.
This decision overturns a lower court order that would have required the reinstatement of these workers while litigation challenging the layoffs continues.
The terminations have sparked controversy, with critics arguing that the administration’s actions are unlawful and target employees based on their probationary status rather than performance.
“The mass terminations of probationary employees are flatly illegal,” said Rob Shriver, former Acting Director of the Office of Personnel Management.
Democracy Forward, a group representing the terminated federal workers, argues that the administration’s actions circumvent the merit principles of the civil service.
“The administration’s mass termination of employees in their first or second year on the job is an unprecedented and grossly unfair circumvention of the merit principles upon which our civil service is based,” said Michelle Bercovici, a partner with the Alden Law Group.
The Office of Special Counsel has recommended halting the terminations, citing the need to protect federal workers from unlawful actions. Skye Perryman, President and CEO of Democracy Forward, emphasized the importance of upholding the independence and integrity of the civil service, stating,
“We will continue to urge OSC and the MSPB to follow the law, protect federal workers, investigate misconduct, and uphold the independence and integrity of our civil service.”
